North Carolina is a no-fault divorce state which means either party may seek a divorce without a wrong being committed.

A wrong by either spouse is not required to seek a divorce.  Either spouse may seek a divorce in North Carolina so long as at least one party has lived in North Carolina for six (6) months or more and the parties have lived separate and apart (not under the same roof) for more than one (1) year.  Both issues of equitable distribution and alimony must be resolved either by agreement or pending in a lawsuit before the judgment of divorce is finalized.
