Family LawAlienation
of Affection

North Carolina recognizes
a third-party claim for
alienation of affection.

This is a claim one spouse may pursue against a third party if the separation and divorce were caused by the actions of said third party.  To prove alienation of affection, a person must prove there was genuine love and affection between the spouses before the separation and that the third party’s actions were the effective cause of the spouse’s alienation of affection.
